Wholesale Terms & Conditions

Retailers must agree to these Terms & Conditions. We reserve the right to discontinue sales to stores who fail to comply. Please note, these terms and conditions are subject to change at any time.

By placing a wholesale order with SWIM SKIN + BODY, you (“the Retailer”) agree to abide by the terms and conditions contained in this Agreement. Please read this Agreement carefully before placing your order.

Ordering & Payment

  • All prices are in Australian dollars. GST is not applicable.
  • The minimum wholesale order is 10 units.
  • Orders will be completed via an online checkout.
  • Upon completion of the online checkout, you will automatically receive an email confirming that your order has been received.
  • Please ensure you give the full and correct shipping address to avoid re-delivery fees.

Shipping

  • All orders are sent via Australia Post. Please contact us if you would like to request a different carrier.
  • Standard shipping is our default service. If you require express shipping, please contact us prior to placing your order.
  • Standard domestic delivery typically takes 4–7 business days, while express orders take 2–3 business days. Delivery times may vary depending on your destination.
  • Once your order has been dispatched, you will be issued a tracking number so you can follow its progress.
  • Please allow extra delivery time during peak periods such as Christmas and Easter.
  • If your order is returned to sender, we will contact you. If you would like us to resend your order, you will be charged postage a second time.

Cancellations, Returns & Exchanges

  • Any cancellations or changes to your order must be submitted via email within 24 hours of placing your order. No changes or cancellations will be accepted after this time.
  • After delivery, if you change your mind or have ordered incorrectly, items may be returned within 14 days of delivery for a refund (excluding shipping costs). All products must be returned unopened, unused and in their original packaging. We will not accept returned products that have already been marked or labelled. Return shipping costs are the buyer’s responsibility and are non-refundable.
  • If your order, or part of it, arrives damaged, please notify us within 3 days of receipt by emailing kate@swimskinbody.com. You will then be asked to return the damaged items for a replacement or full refund.

Exclusivity

We do not offer exclusivity of SWIM SKIN + BODY products in any one geographical area. However, we strive to maintain a non-competitive environment among our retailers by only selling to retailers that are a reasonable distance from each other.

Sale of SWIM SKIN + BODY Products

  • Under no circumstances are SWIM SKIN + BODY products to be resold via a third-party website or location (including Amazon, eBay or similar marketplaces) without our prior written consent. Failure to comply will result in immediate cancellation of your wholesale account.
  • SWIM SKIN + BODY products must be displayed and sold in their original packaging.

Your wholesale account may be suspended or terminated for any of the following reasons:

  • Inappropriate advertising (false claims, misleading claims, etc.).
  • Advertising on sites containing or promoting illegal activity.
  • Violation of intellectual property rights.
  • Fraudulent transactions or suspected fraudulent activity.

In addition to the above, SWIM SKIN + BODY reserves the right to terminate any Retailer’s wholesale account at any time for any violation of this Agreement, or at our sole discretion.

Product Images

  • You may use our graphic and text links on your website and within your email messages, social media or in-store promotional materials. You may also advertise SWIM SKIN + BODY products in online and offline advertisements, magazines, and newspapers.
  • If you are an online retailer, we are happy to supply you with our product or lifestyle images — please email kate@swimskinbody.com to request the ones you require.
  • Images must be used in their supplied state to maintain quality. No cropping, editing, filters or additional compression may be applied.
  • All images are subject to copyright and must only be used to market SWIM SKIN + BODY products.

Liability

SWIM SKIN + BODY will not be liable for indirect or accidental damages (including loss of revenue) due to loss of data, or any result of an intent to cause harm to our business and/or our website(s).

We do not make any express or implied warranties with respect to the products sold by SWIM SKIN + BODY. We make no claim that the operation of our website(s) will be error-free, and we will not be liable for any interruptions or errors.

Indemnification

The Retailer shall indemnify and hold harmless SWIM SKIN + BODY and its related and subsidiary companies, officers, directors, employees, licensees, successors and assigns from any and all liabilities, damages, fines, judgments, claims, costs, losses and expenses (including reasonable legal fees and costs) arising out of or related to any claims sustained in connection with this Agreement due to the negligence, misrepresentation, failure to disclose, or intentional misconduct of the Retailer.
